The members of the Rectorate (in particular the Rector and the Chancellor) are directly and personally responsible for accidents and conditions affecting health for which the organization is (partly) responsible: This concerns, for example, accidents in laboratories or workshops if deficiencies in occupational health and safety are proven or/and no risk assessment can be presented along with necessary and effective improvement measures. In addition, the university management must continuously improve the working conditions with regard to hazards and dangers (prevention requirement - and also § 3 para. 1 ArbSchG) and design the university's organization in such a way that it is suitable for demonstrably implementing all necessary tasks, processes and measures (§ 3 para. 2 no. 1 ArbSchG). This presupposes the provision of the necessary resources and the supervision and control of suitable structures and processes. This comprehensive responsibility of the employer (in this case the Rector or Chancellor) can be systematically reduced to a manageable level via the legal option of Section 13 ArbSchG - the "transfer of duties". The RUB Rectorate continues to bear overall responsibility for occupational health and safety. This includes organizational responsibility and responsibility for monitoring the transfer of duties.
